A Kingston man who was convicted in a domestic violence case was sentenced to more than seven years in state prison.
The Ulster County District Attorney’s office said Carlos Caal Chub, 30, of Kingston was convicted on April 9 of second-degree assault, first-degree stalking and third-degree criminal mischief, all felonies; and third-degree assault, second-degree unlawful imprisonment and three counts of endangering the welfare of a child, all misdemeanors.
Chub was sentenced to six years in state prison for the assault and stalking convictions and 1 1/3 to 4 years in state prison for the criminal mischief conviction. Those sentences are to run consecutively.
For the misdemeanor convictions, his maximum sentence is one year in jail, which is required by state law to run concurrently to the state prison sentences for the felony convictions.
According to the district attorney’s office, Chub allegedly assaulted his victim, the mother of his three daughters, while they were both at a barbecue on Elmendorf Street in Kingston on April 20, 2024, punching her twice in the head after she intervened in a dispute between another couple at the barbecue.
Chub then took her phone when he saw her trying to call police.
The victim then left the barbecue to gather her things and leave their home in the Town of Ulster with their daughters. Chub broke into the home through a basement door with a hammer.
Chub reached the woman and assaulted her for an extended period of time while she was holding their infant daughter, rendering her unconscious. He also shoved and hit their two older daughters with a hammer, the district attorney’s office said.
Employees at a nearby restaurant helped the woman and her children get to safety. Police who were called quickly located Chub and took him into custody. A grand jury indicted him later that month.
“The investigation, indictment and prosecution of this case and today’s sentence strongly reinforce the message that domestic violence is evil in any community, and we all have a responsibility to make sure that those who commit it are held to account,” Ulster County District Attorney Emmanuel C. Nneji said in a statement.
Chub’s attorney, William D. Pretsch, could not immediately be reached for comment.
