'Just pass away already' Fabens woman arrested on animal cruelty charge

A Fabens woman arrested on suspicion of animal cruelty allegedly told deputies that she wished her sick dog would “just pass away already,” authorities said.

Deputies arrested 26-year-old Kimberly America Frescas in connection with one count of cruelty to non-livestock animals after her 6-year-old pug named Toby was found severely underweight, El Paso County Sheriff’s Office spokeswoman Priscilla I. Contreras said in a news release.

Daniel Robledo, who is listed in court records as Frescas’ attorney, could not immediately be reached for comment.

‘Just pass away already’

El Paso County Animal Welfare officers conducted a welfare check after PAWsitive Rescue of El Paso, a nonprofit animal rescue organization, reported a pug in poor condition on June 17 at a home in the 1000 block of NW 2nd St. in Fabens.

Animal Welfare officers found Toby “severely underweight,” the news release states. Deputies identified Toby’s owner as Frescas.

Frescas told deputies that Toby had been sick for more than two weeks. She allegedly admitted she had not sought proper veterinary care.

Frescas allegedly said she wished her sick 6-year-old pug would “just pass away already,” the news release states.

Animal Welfare officers removed Toby from the home and took him to a veterinarian for immediate medical treatment. Veterinary records later revealed Toby weighed only half the average weight of an adult male pug, the news release states.

In a photo released by the sheriff’s office, Toby appears sick and emaciated, with his ribs visible.

Deputies obtained an arrest warrant for Frescas on the animal cruelty charge on Monday, June 22. Frescas was arrested the next day and booked into the El Paso County jail on a $4,000 bond. She was released from jail on Wednesday, June 24, after posting bail, jail logs show.
