A man convicted of raping, torturing and killing his 75-year-old Stockton neighbor in 1996 — and previously granted parole — will have his release reconsidered in October.
In 1997, James Dennis Lynch, now 46, pleaded guilty to the rape of Stockton resident Hilda Armanino Boggiano. At the time of the crime, Lynch was 16 years old.
Lynch had raped Boggiano on July 6, 1996 with an electric massager and then stabbed her with a butcher knife from her kitchen inside her home located in the 100 block of West Essex Street.
He was tried as an adult due to the seriousness and gravity of the crime.
Superior Court Judge Stephen G. Demetras had sentenced Lynch to 10 years for the sexual assault and 26 years to life for the murder. He was not eligible for parole until serving 85% of the time.

According to the California Department of Corrections and Rehabilitation records, Lynch was denied parole on Jan. 28, 2021 for five years.
However, on Jan. 15, a California parole panel voted to grant Lynch parole.
Following the parole grant, San Joaquin County District Attorney Ron Freitas submitted a formal objection to the decision to Gov. Gavin Newsom and urged intervention, according to the DA’s office.
CDCR records show that Newsom referred Lynch’s parole grant to be reviewed on May 22 by the California Board of Parole for an en banc hearing.
During an en banc hearing the board may affirm the hearing panel’s decision, modify the decision, or order a rescission hearing to determine whether the person’s grant of parole should be rescinded, according to the CDCR website.
At Lynch’s en banc hearing, the board directed that Lynch receive a rescission hearing, where concerns raised by the victim’s family and Freitas will be further examined, the DA’s office said in a statement.
At the next hearing, tentatively scheduled for October, the board will determine if there is a good cause to either postpone or cancel Lynch’s parole date.
