Rep. Eric Swalwell on Sunday announced plans to drop from California’s governor’s race amid sexual assault allegations, bringing more disorder to an already chaotic election cycle.
Then, the following day, Swalwell announced that he would be resigning from Congress.
With Swalwell’s withdrawal, it brings into question whether or not his name will appear on the June primary ballot.

Will Swalwell’s name appear on June primary’s ballot?
The California Elections Codes does not provide candidates who have filed nominations documents for statewide offices, such as governor or lieutenant governor, with the option to withdraw those documents, a spokesperson for the California Secretary of State said.
As such, since Swalwell filed nomination documents, his name will appear on the June primary ballot, according to the spokesperson.

On April 14, California Gov. Gavin Newsom announced that the state will hold a special election on August 18, 2026, to fill the vacancy in the office of the U.S. House of Representatives.
Swalwell faces accusations of sexual assault
On Friday afternoon, the San Francisco Chronicle published allegations of sexual assault from a former staffer against Swalwell, the leading Democratic candidate. CNN followed with sexual assault allegations from the same staffer and three other women who alleged other forms of sexual misconduct.
A wide array of pollical figures called for Swalwell to withdraw from the race.
Swalwell denied the allegations in a Friday video on social media, saying the claims were politically motivated. By Sunday evening, however, Swalwell announced plans to drop out of the race but continued to refute the allegations.
“To my family, staff, friends, and supporters, I am deeply sorry for mistakes in judgment I’ve made in my past,” Swalwell wrote in a post on X. “I will fight the serious, false allegations that have been made — but that’s my fight, not a campaign’s.”
The next day, Swalwell announced his plans to resign from Congress.

Though Swalwell announced his intent to resign from the U.S. House of Representatives, he did not provide a specific timeline for his final day.
“I will work with my staff in the coming days to ensure they are able, in my absence, to serve the needs of the good people of the 14th congressional district,” Swalwell wrote in a post on X.

Should a member of the U.S. House of Representatives resign, their seat becomes vacant, necessitating a special election to fill the vacancy, per the U.S. Constitution.
Unlike the Senate, the seat cannot be filled by a temporary appointment. The seat will remain open until a new member is elected in a special election called by the state’s governor. California Gov. Gavin Newsom has 14 days to proclaim a primary and then the general election date.
“Our office is reviewing the matter,” Newsom’s office said in a statement provided to KTVU. “Once the seat is officially vacant, our office will make an official announcement.”
