MANITOWOC COUNTY – Damian L. Hauschultz, a 22-year-old Mishicot man who was convicted of first-degree reckless homicide in the 2018 death of 7-year-old Ethan Hauschultz, will receive a new sentence.
Damian’s attorney, Karin Jonch-Clausen, filed a motion for post-conviction relief in January, asking for a new trial. During a status conference March 3, Jonch-Clausen agreed to withdraw the motion in exchange for a re-sentencing hearing.
The re-sentencing hearing has been set for April 24 and will be presided over by Sheboygan County Judge Samantha Bastil.
According to the agreement, Bastil will not review the transcript from Damian’s 2021 sentencing, but will hear arguments from each party on April 24 and will review the victim impact statements and the pre-sentencing investigation.
Damian was convicted of killing Ethan in 2021 and sentenced by Judge Jerilyn Dietz to 20 years in state prison. He was 14 at the time of Ethan’s death. He now resides at the Stanley Correctional Institution in Chippewa County.
Damian’s father, Timothy Hauschultz, is still facing felony child neglect and child abuse charges in Ethan’s death. His trial was held in limbo while Damian’s attorney filed an appeal. It was delayed again because of Damian’s post-conviction relief motion. Timothy Hauschultz’s case is now set for a scheduling hearing March 18.
The criminal complaint alleges Timothy Hauschultz ordered his son, Damian Hauschultz, to supervise the punishment that led to Ethan’s death. Timothy and his wife, Tina McKeever-Hauschultz, were Ethan’s guardians at the time. Damian Hauschultz was sentenced to 20 years in prison in September 2021 and Wisconsin Supreme Court decided in September 2024 not to hear an appeal to his conviction.
McKeever-Hauschultz was also arrested in Ethan’s 2018 death and convicted of child abuse-failure to prevent great bodily harm and failing to prevent mental harm to a child, both felony charges. She was sentenced to five years in prison in 2021 but has since been released.
