A Milwaukee man admitted to police he drank “five or six” alcoholic drinks on an empty stomach within an hour of a crash that killed another driver a week ago, prosecutors say.
Alan Ontiveros, 23, is charged with several felonies, including homicide by intoxicated use of a vehicle and second-degree reckless homicide in connection with a deadly June 21 crash at 11th Street and Greenfield Avenue.
The collision resulted in the death of Faisal Hussain, 47, of Milwaukee.
Ontiveros made his initial court appearance on June 27, online court records show. His bail was set at $150,000.
Milwaukee County Jail records indicated he remained in custody as of Monday, June 29.
According to the criminal complaint, filed in Milwaukee County Circuit Court on June 25, two officers were dispatched to a “serious motor vehicle accident” near 12th Street and west Greenfield just after 1:15 a.m.
When they got to the scene, the officers “observed a very serious head-on crash involving two moving vehicles and several legally parked vehicles that were struck from the force of the collision,” the report says.
One of the officers performed lifesaving measures on a person, while the other “chased man on foot from the crash after multiple witnesses pointed and identified him as a driver trying to run from the scene,” the complaint said.
The fleeing man, later identified as Ontiveros, eventually was caught.
According to the complaint, he had slurred speech, bloodshot and glassy eyes and difficulty maintaining his balance. He had a BAC of 0.136, nearly twice the legal limit of 0.08, the complaint said.
Police also reportedly found an open can of vodka seltzer inside Ontiveros’ car.
Wisconsin Department of Transportation records indicate Ontiveros does not possess a valid driver’s license, the complaint said.
Surveillance video from a nearby business reportedly showed a 2015 Buick LaCrosse, allegedly driven by Ontiveros, crossing the center line and causing the collision.
Hussain was heading east in a 2007 Honda Civic when the crash occurred.
Ontiveros estimated he drank “five or six drinks” on an empty stomach in an hour before the fatal collision, according to the complaint. He also told police he smoked a marijuana blunt at the bar and admitted that he had never been issued a valid driver’s license, the complaint said.
Milwaukee Police Department data indicates that 15 people have died in vehicle crashes in 2026 as of June 25, the most recent figure available. In all, 62 people were killed in crashes during 2025.
Ontiveros also is charged with hit and run involving death, knowingly operating a vehicle without a valid license causing death and homicide by use of vehicle with a prohibited alcohol concentration, all felonies.
His preliminary hearing is scheduled for July 6.
