Judge denies Marcy CO motion to withdraw guilty plea

According to court records, Judge Robert Bauer has denied the motion for David Walters to withdraw his guilty plea in the Robert Brooks case.

Brooks, an incarcerated individual transferred to Marcy Corrections Facility on Dec. 9, was brutally beaten with his hands cuffed behind his back by corrections officers while in custody. He died as a result of his injuries on Dec. 10. An autopsy was conducted by the Onondaga County Medical Examiner’s Office and, in February, Brooks’ death was ruled a homicide.

On. Sept. 22, Walters pleaded guilty to the lesser of his charges, second-degree manslaughter, with a sentence of two and a third to seven years in state prison.

On Nov. 17, Walters’s attorney filed to withdraw his guilty plea.

The motion was denied by Judge Bauer and Walters will go ahead with sentencing on Nov. 21.

Three corrections officers went before Judge Bauer in October — David Kingsley, Mathew Galliher, and Nicholas Kieffer. Kingsley was the only one found guilty of second-degree murder and first-degree manslaughter.
