Family sues Milwaukee police, motorist after fatal collision

The family of a pedestrian killed at an intersection on Milwaukee’s north side is suing the city of Milwaukee, its police department and the man criminally charged in her death.

Court records show David Terrell Hall, 48, of Milwaukee, is scheduled to go on trial Oct. 5 in connection with the July 27, 2024, collision that killed Carla Tyson, 57.

He was served in his jail cell with legal papers naming him as a defendant in wrongful death lawsuit filed July 6 by Tyson’s son, Jason R. Lucious.

Also listed as defendants are the city of Milwaukee, the Milwaukee Police Department and MPD Officer Andrew Stanton.

Tyson’s estate and Pierre Tyson, a Racine man named special administrator in the case by the Kenosha County Probate Court, join Lucious as plaintiffs.

They allege Hall struck Tyson and an MPD squad car driven by Stanton, who on his way to an unrelated call, also hit Tyson seconds later. They claim that both are responsible and that her death was “wrongful and preventable.”

According to criminal and civil complaints, Hall was driving a Dodge Ram pickup truck east on West North Avenue when he struck Tyson at the intersection with North 14th Street. She was crossing the street.

Surveillance video shows the truck did not stop after the crash, according to the complaints.

Just 25 seconds later, the civil complaint alleges an MPD squad vehicle that was traveling to another call for service also ran over Tyson as she was lying in the street.

The squad vehicle’s officers then pulled over and approached Tyson, who was pronounced dead at the scene at about 2:50 a.m.

“Failing to activate his emergency lights or siren before proceeding through the area where a hazard was, or should have been reasonably discoverable,” plaintiffs’ attorney Donald Murphy, of Milwaukee, wrote in the lawsuit.

Attempts to reach Milwaukee City Attorney Evan Goyke were unsuccessful on July 8.

Investigators reportedly connected Hall’s vehicle to the crash with debris found at the scene and surveillance footage, the criminal complaint said. The complaint also indicates Hall admitted during an interview he was driving the truck at the time but claimed he did not realize he had hit a person.
