El Paso police arrested a teenager accused in a shooting during a fight involving teens on Scenic Drive two months ago.
Maximus Angel Guevara, 17, is accused in a shooting that occurred about 4:40 a.m. on Mother’s Day, May 11, when witnesses saw about two dozen juveniles being loud, causing a ruckus and fighting on Scenic Drive, Assistant District Attorney Flerida Zabala said at a teleconference bond hearing on Tuesday, July 1. There were no injuries reported.
Scenic Drive is a popular winding road with a lookout spot on the southern edge of the Franklin Mountains with panoramic views of the El Paso-Juárez Borderland.
Guevara, of the Lower Valley, was arrested last week on charges of deadly conduct, unlawful possession of a weapon and possession of less than two ounces of marijuana, according to an El Paso County Jail log.
In the Texas criminal justice systems, persons 17 and older are considered adults.
Witnesses told police that “Max” shot a gun toward an unknown male, bullet casings were found at the scene and a vehicle seen in an Instagram video of the incident was linked to Guevara’s mother, Zabala said.
Last week, police set up surveillance and followed the vehicle to a Family Dollar store on Alameda Avenue, near North Carolina Drive in the Lower Valley, the prosecutor said.
Guevara allegedly had a handgun on him when he was arrested and a police dog found less than two ounces of marijuana in the glovebox and a joint in the rear seat of the vehicle, Zabala said. The gun had been reported stolen in Las Cruces.
During the hearing, defense attorney, Raoaa King argued the case should be a lesser charge of discharge of a firearm (Class A misdemeanor) rather than a felony deadly conduct charge. She mentioned Guevara had been a student at Ysleta High School.
Magistrate judge lowers bonds, sets curfew
Magistrate Judge Ruben Nunez lowered the deadly conduct bond amount from $60,000 to $5,000, the unlawful carrying of a weapon bond was lowered from $10,000 to $2,500 and the marijuana possession was dropped from $300 to a personal recognizance, PR, bond.
As part of the bond terms, the judge ordered that Guevara not use drugs or alcohol, prohibited him from possessing any firearms, weapons and ammunition, he can’t have contact with the complainants and will have a curfew of 6 p.m. to 6 a.m. daily.
Guevara was released Tuesday on a surety bond from the El Paso County Jail Annex, according to a jail log.
