A son was acquitted of murder in a 2023 El Paso road rage shooting, while his father and brother are still set to go to trial on homicide charges, court records show.
An El Paso jury found Jose Alberto Orozco not guilty of murder on Wednesday, May 20, in connection with the death of 32-year-old Marcos Fino Jr. during a June 6, 2023, road rage incident in the 5900 block of Doniphan Drive in El Paso’s Upper Valley.
Judge Sam Medrano of the 409th District Court presided over the trial at the Enrique Moreno County Courthouse in Downtown El Paso.
El Paso Police Department officers arrested Jose Alberto Orozco, his father, Raul Alberto Orozco, and his brother, Cristian Bradley Orozco, in connection with the shooting.
El Paso District Attorney’s Office officials declined to comment since the murder cases against Raul Orozco and Cristian Orozco are still pending.
Raul Orozco is set for trial on Aug. 7, while Cristian Orozco is scheduled to go to trial on Sept. 18, court records show.
Road rage allegedly leads to fatal shooting
Raul Orozco was driving a truck about 6 p.m. on June 6, 2023, when he got into a “road rage” altercation with Fino, who was driving a car on Doniphan Drive near Montoya Road in the Upper Valley, El Paso Police Department officials said when the father and two sons were arrested.
The incident allegedly led Raul Orozco to chase Fino, who had three other people in his car. Raul Orozco is accused of calling his sons for help, police said.
The two sons came to the scene and maneuvered their vehicle in front of Fino’s car, blocking him in, police said. Raul Orozco allegedly blocked the car from behind with his truck.
The men began arguing in the street, which led to a fight between the Orozco brothers and Fino and a man who was a passenger in Fino’s car, police said. Jose Orozco was accused of fatally shooting Fino.
The father and sons left the scene and called police from Montoya Road, police said.
A passenger in Fino’s car was rushing to take Fino to a hospital when he flagged down a police car on Doniphan Drive near Artcraft Road. Fino died in the shooting.
