Delaware County man charged 11 months after fatal shooting in Madison Township

A Delaware County man has been arrested and charged with murder nearly one year after a fatal shooting in Madison Township.

Austin Hagemann, 25, was arrested on the morning of Nov. 18 at his home in the portion of Westerville in Delaware County by deputies with the Franklin County SWAT Team and members of the U.S. Marshals Southern Ohio Fugitive Apprehension Strike Team, or SOFAST, the sheriff’s office said in a news release.

Hagemann is accused of fatally shooting 38-year-old Jack Hamilton while the two men were in a fight. In addition to murder, Hagemann has been charged with felonious assault, discharging a firearm on or near a prohibited premises, and improper handling of a firearm, according to the sheriff’s office.

On Dec. 19, 2024, at around 3:30 p.m., Madsion Township police officers and sheriff’s deputies responded to a shooting in the 3000 block of Noe Bixby Road. According to the sheriff’s office, Hagemann went to Hamilton’s home to take back some auto parts that he believed Hamilton owed him. The two got into an escalating argument, the sheriff’s office said.

Hagemann eventually tried to leave in his van, but Hamilton jumped on the running board on Hagemann’s van and began punching him, the sheriff’s office said. Hagemann continued backing out of the driveway and onto Noe Bixby Road while Hamilton stayed on the running board, according to the sheriff’s office.

At that point, the sheriff’s office said Hagemann allegedly pulled out a gun and shot Hamilton once in the chest.

Medics transported Hamilton in critical condition to Mount Carmel East Hospital, where he was pronounced dead at 4:08 p.m.

After the investigation, the case was sent to the Franklin County Prosecutor’s Office for review. The evidence was then presented to a grand jury, which indicted Hagemann on Nov. 12.

Hagemann is in custody at the Franklin County jail.
