Malachi Wynder, the man who allegedly opened fire in the New Hartford mall, was back in court before Judge Michael Nolan for a brief session on Aug. 12.
Wynder, 20, was arrested March 2 after an incident the day before, in which police say he shot and injured a man at Sangertown Square Mall in New Hartford. The incident led to the entire shopping center being shut down when Metro SWAT responded and multiple people were ordered to shelter in place during a few tense hours.
The prosecution had went forward with a motion to acquire a DNA sample from Wynder, known as a buccal swab, to which his attorney challenged. The motion was made on July 11 and Judge Nolan had reserved decision on the matter.
On Aug. 12, Judge Nolan handed down his decision, finding in favor of the prosecution. Nolan adjourned the case until Wynder’s suppression hearing on Sept. 18 at 10 a.m.
