3 arrested after patron's death at Greece bar; staff accused of moving man, lying

Three people accused of moving an unconscious patron of a Greece bar within the business and lying to police have been arrested.

The customer – 68-year-old John Acito of Greece – was apparently drinking alcohol at Dave’s Long Pond Pub, 510 Long Pond Road on Dec. 17, 2025, when first responders were called to the scene to tend to an unconscious patron, according to Greece police.

Acito was taken to Strong Memorial Hospital to be treated for a “significant head injury,” officers said. He died from his injuries on Jan. 1, according to police.

Due to the severity of the injury and inconsistencies surrounding the circumstances prior to the 911 call, GPD’s criminal investigation division investigated the death, spoke with the bar owner and staff and reviewed surveillance video from inside the bar, and 911 recordings.

The footage showed that Acito was drinking inside the bar after the 2 a.m. closing time on Dec. 17. Sometime early that morning, video showed that Acito swayed, fell and his head on a table and the floor, according to police.

According to police, staff knew Acito was unconscious – but breathing – and delayed calling 911 for 30 to 40 minutes as they continued closing the bar. Staff “did not treat the situation as an emergency,” officers said in a news release.

Video shows workers placing Acito’s coat on him and moving him toward the front door of the pub “in an apparent attempt to give the appearance that he had been found outside before first responders were contacted,” according to police.

When the employees called 911, they told dispatchers that Acito was found in the bar’s parking lot and was brought inside, according to the news release.

“Detectives further determined that staff provided inaccurate information regarding the status of the surveillance cameras,” the news release read.

According to the Monroe County Medical Examiner’s Office, Acito’s death was ruled accidental due to complications from blunt force head injuries. The ME’s Office also noted that the delay in contacting first responders “did not contribute to his death.”

John W. Moore, 58, of Gates, Crystal A. McWilliams, 42, of Rochester, and David A. Geer, 64, of Green Acres, Florida were each charged with tampering with physical evidence, a felony, officers said. Geer, according to police, owns the bar. The other two are employees.

Greece police continues to investigate the incident.
