WINCHESTER, IN — An Ohio man convicted in Randolph Circuit Court of vicarious sexual gratification has been sentenced to 16 years in prison.
The sentence received on Thursday, June 25, by 60-year-old Kevin W. Smith — a resident of Union City, Ohio — was the maximum penalty for a Level 3 felony conviction.
According to an affidavit filed when Smith was arrested in November 2024, the vicarious sexual gratification charge was based on an allegation Smith had forced two juveniles to engage in sexual activity with one another, reportedly at knifepoint.
Under the terms of a plea agreement, six other charges pending against Smith — rape and five counts of child molesting — were dismissed.
The affidavit said two accusers, one now an adult, told investigators they had been repeatedly sexually assaulted by Smith.
The Ohio man received credit for 323 days already spent in the Randolph County Jail.
In August 2025, Smith was convicted of four counts of rape in Darke County, Ohio, also resulting in a 16-year prison term.
His Randolph County sentence will be served at the same time as his Ohio prison term.
