South Daytona man confronts neighbor over speeding, gets shot at

A South Daytona man who went to his neighbor’s home on Feb. 11 and emptied a trash can in his yard while there to confront him for speeding on his street ended up getting shot at, according to court documents.

The accused shooter, Dana Crispen Rowden, 52, then went into his Oriole Lane home after the 11:30 a.m. incident and refused to come out when police arrived. He surrendered several hours later and was arrested, according to his charging affidavit.

Rowden was charged with aggravated assault with a deadly weapon and was in the Volusia County Branch Jail on Feb. 12 without bail, jail records showed.

The victim, Matthew Wallace, was not injured, police said.

According to the arrest report filed with the court, the incident occurred around 11:30 a.m. Feb. 11.

Responding officers met with Wallace at his Oriole Lane home where he recounted what happened, the report states.

Wallace told police he learned from his neighbors that Rowden had been speeding on Oriole Lane again in his white BMW, so he went to Rowden’s home to confront him, the report said.

Wallace said he knocked on Rowden’s door but there was no answer, so he dumped a tote bag and a trash container that were in front of Rowden’s home and walked away, according to the report.

As Wallace walked away, Rowden opened his door and asked Wallace “Do we have a problem?” And Wallace responded, telling Rowden that he was sick of his speeding and that he would “expletive) him up,” the report detailed.

Wallace said Rowden mumbled something and went inside his home. Wallace said he was about 50 yards away when he heard a gunshot. He turned around and saw Rowden on his porch pointing his arm at him and heard a second gunshot. Wallace then ran to his home, South Daytona police said.

Several witnesses told police they saw Wallace walk over to Rowden’s home and dump trash in his yard, and they saw Rowden shoot at Wallace when he was about four houses away, according to information in the charging document.

After Rowden was arrested, he invoked his right to remain silent, his arrest report said.

In searching Rowden’s property, police located a .45 caliber shell casing on the ground in front of his home, his arrest document shows.

Rowden is known to the South Daytona police. In 2012, they charged him with assault on a law enforcement officer and disorderly conduct, charges that were dismissed by prosecutors, court records show.
