An El Paso man asked his roommate if they were “good” before allegedly pulling out a gun and fatally shooting him in the chest, court documents state.
David Daniel Hall, 41, was “extremely intoxicated” when he allegedly killed Joshua Lopez, 33, on Wednesday, July 22, outside an apartment in the 3600 block of Fred Wilson Avenue in the Logan Heights neighborhood, a criminal complaint affidavit states.
El Paso attorney David Nunez, who is representing Hall, told the El Paso Times that a police news release and the affidavit “contain material differences concerning basic details of the incident,” but declined to comment on the differences.
He added, “We will protect Mr. Hall’s constitutional rights and address the allegations in the proper forum.”

Officers responded to a report of a shooting about 7:15 p.m. and found Lopez with gunshot wounds to his chest and back. Lopez was taken to University Medical Center of El Paso, where he died from his wounds.
Detectives with the El Paso Police Department’s Crimes Against Persons Unit were called to the shooting and interviewed a neighbor. The neighbor said Lopez and Hall had been roommates for about two years.
Hall, who was reportedly intoxicated, got into a physical altercation with Lopez for unknown reasons, the affidavit states. Lopez grabbed a knife, left the apartment and walked to the neighbor’s apartment.
Lopez knocked on the door and asked to be let into the apartment. He told the neighbor through the door that Hall was “extremely intoxicated,” the affidavit states. Hall allegedly walked up to Lopez as he was speaking to the neighbor.
The neighbor told investigators he saw Hall wearing a “white shirt with what appeared to be suspected blood on the right side of his chest area and a laceration on his left palm,” the affidavit states.
Hall repeatedly asked Lopez if they were “good,” the neighbor told investigators. Lopez did not respond. Hall allegedly pulled out a handgun and shot Lopez in the chest. He fled the shooting before police arrived.
Investigators found multiple spent shell casings at the shooting. The neighbor identified Hall as the suspect, the affidavit states.
Hall was later found by officers and arrested on suspicion of murder. He was booked into the El Paso County jail on Thursday, July 23, on a $150,000 bond. He remains jailed as of Monday, July 27, jail records show.
