No charges coming for May fatal traffic crash in Jackson Township

MASSILLON ‒ No charges will be filed in connection with a May 22 crash that killed a 55-year-old Bolivar woman in Jackson Township.

Chief Massillon Prosecutor Andrea C. Bartos wrote in an email that the 76-year-old Bolivar man who was at fault suffered significant injuries in the two-car collision that occurred at Wales Avenue and Strausser Street NW.

Those injuries “had significant implications as to our ability to legally prosecute him,” she wrote.

“Thus, with the input and approval of the driver of the other vehicle as well as decedent’s family, charges will not be pursued,” Bartos wrote.

The Jackson Township police report about the crash that killed Gay L. Rothacher says the Bolivar man was southbound on Wales when he entered the Strausser intersection on a red signal. A black 2015 Ford Fusion that was eastbound on Strausser hit the passenger side of the white 2005 Toyota Scion xB driven by the Bolivar man. Rothacher was his front-seat passenger.

The driver of the Fusion was a 16-year-old girl from Green. The crash report said she was injured.

Bartos wrote that the Massillon Law Department received the completed crash investigation report in early September and decided on Oct. 8 not to charge the motorist who caused the crash.
