CANTON ‒ Two former city police officers who pleaded guilty to misdemeanor charges in connection with the death of Frank E. Tyson are scheduled to be sentenced Sept. 24 in Stark County Common Pleas Court.

Schoenegge faces up to 90 days in jail and a $750 fine, and Burch up to 30 days in jail and a $250 fine.

Both officers, who are White, pleaded guilty on Aug. 10 as jury selection was underway for their trial. Both had originally been charged with reckless homicide, a third-degree felony that carries a potential three-year prison sentence. As part of a negotiated plea agreement, both men agreed to resign from the Canton Police Department.

Tyson, a 53-year-old Black man from Canton Township, died on April 18, 2024, after struggling with the former officers during an arrest at a private club. They left him face-down on the floor for nearly eight minutes while he was handcuffed.

An autopsy ruled Tyson’s death a homicide. A preliminary report listed multiple causes of death: cardiopulmonary arrest, meaning that his breathing and blood circulation had stopped, in association with physical altercation and prone restraint; ischemic cardiovascular disease, a condition in which the heart muscle does not get enough blood and oxygen due to narrowed or blocked coronary arteries; acute intoxication by cocaine and alcohol; and obesity.
