LAFAYETTE, IN — A civil lawsuit filed June 22 accuses Card Haven, a Lafayette consignment shop, of not returning collectable Pokemon cards the store’s owners were supposed to sell.
Valentin Ortiz of Hamilton County, Indiana, filed suit in Tippecanoe County accusing the store and its owners — Aaron Hawkins and Thomas Hogan — of not returning an estimated $44,000 worth of Pokemon cards that the store owners were supposed to sell on consignment, according to the lawsuit.
The Journal & Courier telephoned Hawkins and Hogan, both of whom declined to comment. The Journal & Courier also drove to the card shop, which was closed − even though a sign by the door said the store is open 11 a.m. to 11 p.m. Monday through Friday.
Ortiz gave the store owners 500 Pokemon cards that the lawsuit estimates are worth $40,000, according to the lawsuit, which noted the contract between Ortiz and the card shop was signed Dec. 5.
The store sold some of Ortiz’s cards and paid $5,000 to Ortiz, according to the lawsuit.
When Ortiz could not reach Hawkins or Hogan or any representatives of the store, he asked for the cards to be returned.
Some of the cards were returned, according to the lawsuit, but 86% of the cards were missing and unaccounted for. Ortiz’s lawsuit estimates the missing cards are valued at $44,000.
Ortiz also accused the store, Hawkins and Hogan of ignoring the contract’s mediation clause. Ortiz’s lawsuit alleges Card Haven, Hawkins and Hogan breached their contract, breached their fiduciary duty and accuses the shop and its owners of theft and unjust enrichment, according to the lawsuit.
No hearings have been scheduled in the case, according to court documents.
