MUNCIE, IN — A Daleville man who allegedly fired gunshots at police has been formally charged with four counts of attempted murder.
In addition to those Level 1 felonies, each carrying up to 40 years in prison, 54-year-old Nathan Wayne Carter was charged on Monday, Aug. 17, with criminal recklessness and resisting law enforcement.
Delaware County sheriff’s deputies responded to a report of shots fired at Carter’s home in the the 8400 block of South Lynn Street in Daleville on the early evening of Sunday, Aug. 9.
After deputies arrived at the scene, Daleville resident Nathan Wayne Carter, 54, exchanged gunfire with the law enforcement officers, according to an Indiana State Police news release.
Although no one was hit by the gunfire, state police are investigating the deputies’ use of firearms. Evidence gathered by ISP will be submitted to Delaware County Prosecutor Eric Hoffman, who will determine whether the gunshots were justified.
After the gunfire, Carter remained barricaded in his home, the ISP release said.
A standoff continued until about 4:30 a.m. the following day, when members of the county SWAT team entered Carter’s home and took him into custody.
In a later interview with police, Carter reportedly said he “didn’t remember firing the rounds at law enforcement.”
Investigators found 11 spent .45-caliber shell casings in Carter’s home, according to an affidavit.
The felony charges against Carter were filed Monday in Delaware Circuit Court 4. He continues to be held without bond in the Delaware County Jail.
