A Gadsden County jury found a 27-time convicted felon guilty of burglary with assault and sexual battery in connection with a 2021 attack on an intellectually disabled adult, according to the State Attorney’s Office.
Prosecutors said Henry W. Fain Jr. unlawfully entered the victim’s home in November 2021 and carried out a violent sexual assault.
Evidence presented during a three-day trial in late October included doorbell-camera images, a sexual-assault exam kit, the victim’s clothing and bedding, a recorded interview with the defendant and photos recovered from his phone. Expert witnesses from the Florida Department of Law Enforcement and medical personnel also testified.
Fain testified in his own defense and claimed the victim had invited him to the home and consented to sexual activity.
Jurors deliberated for nearly three hours before returning guilty verdicts.
According to prosecutors, Fain qualifies as both a Prison Releasee Reoffender and a Habitual Violent Felony Offender, making him subject to enhanced sentencing under Florida law. Sentencing is scheduled for Dec. 2.
Assistant State Attorney Sara Hassler prosecuted and Assistant Public Defender Courtney Freeman represented Fain. Circuit Judge Ronald Flury presided.
