Months before they officially filed for divorce last week, Dan and Jennifer Gilbert had reached a confidential postnuptial agreement for dividing up property and other matters.
The existence of that April 17, 2025, agreement is referenced in newly released divorce filings for the wealthy high-profile couple.
The filings were stamped as received last week in Oakland County Circuit Court’s family division, but were not made publicly available until Monday, Sept. 8. (A representative for the Gilberts did share some of them with some media outlets on Friday.)
The actual postnuptial agreement is not disclosed in the filings released Monday, although court documents say it “resolved all issues arising out of the parties’ marriage,” including alimony, taxes, the division of property and other related issues. The Gilberts’ children are now grown and are no longer minors.
A court hearing on the Gilberts’ proposed consent judgement order for their divorce is scheduled for Nov. 10 before Judge Amanda Shelton. Dan Gilbert is the plaintiff in the case and Jennifer Gilbert is the defendant.
Lowell Friedman, a family lawyer and founding member of Friedman Law Firm in Royal Oak, said that judges don’t always enforce postnuptial agreements as they were written, particularly when they are drafted close in time to a divorce filing.
But the fact that Dan and Jennifer Gilbert each signed their name to the proposed consent judgement would seem to indicate that they are in agreement, and therefore a judge is likely to approve the postnuptial deal.
“Because they both agreed to its terms, it’s smooth sailing” Friedman said.
Confidential settlements in consent judgements generally do not become public record, he added.
The Gilberts have been powerful forces in metro Detroit philanthropy and have reportedly been married for 30 years. Their residence for years was in the Oakland County village of Franklin.
Dan Gilbert is the founder of Detroit-based Rocket Companies, the publicly traded corporate parent of Rocket Mortgage. Jennifer Gilbert sits on the Rocket Companies board and is an interior designer with her own design business.
A representative for Gilbert’s businesses had no immediate comment for this story.
