Kenosha couple wants state Supreme Court to review Brewers 50/50 raffle lawsuit

The Kenosha couple suing the Brewers Community Foundation Inc. over $13,000 in 50/50 raffle winnings they say they were unfairly denied has petitioned the Wisconsin Supreme Court to hear their case.

Matthew and Annette Flynn confirmed Tuesday, June 16, they have filed a petition for review with the state’s highest court. They have not yet received word whether the panel will consider their lawsuit. Earlier this month, the Wisconsin Court of Appeals ruled against the Flynn’s, barring them from collecting the money they claim they won at a Milwaukee Brewers home game three years ago.

The state Supreme Court may decide not to hear the case. However, anyone seeking a judgment from the court must submit a petition for review. Every year, the court agrees to hear about 10% of the cases submitted for review.

In their petition, the Flynns ask the court to consider issues outside of their specific circumstances including “charitable gaming, contractual ‘sole discretion’ provisions, discovery of evidence controlled by one party, and the treatment of digital video evidence identified as a trial exhibit but not included in the appellate record,” they wrote in an email to the Milwaukee Journal Sentinel.

The couple has long argued they are entitled to the $13,000 in prize money that was handed out during a raffle held at a July 7, 2023, Brewers home game against the Cincinnati Reds.

Rules of the raffle require the person with the winning ticket to claim their prize at a 50/50 table on the loge level concourse. The winner was given “until the end of the top of the 7th inning (or until the third out is recorded in the top of the inning)” to do so.

The couple claims Annette Flynn arrived at a 50/50 table before the deadline, despite, they say, being misdirected by arena staff.

Another drawing was held and the prize money then went to another winner.

A civil court judge in Milwaukee County found the Flynn’s lost fair and square, and the appeals court upheld that decision.
