Volusia County is asking a judge to dismiss a lawsuit against its efforts to bring a motocross facility to the area.
The motion describes DeLand resident Lourdes Gonzalez’s lawsuit as “meritless” and seeks to recover attorneys’ fees and costs.
Gonzalez’s lawsuit says that the project has moved forward despite never having a comprehensive review, and she also believes the county has violated its Comprehensive Plan.
Gonzalez filed the lawsuit on April 1 in circuit court. She describes herself as a taxpayer “adversely affected” by the county’s actions. The county’s motion to dismiss says she lacks standing to bring the case.
