The Macomb County Prosecutor’s Office has declined to issue charges in two cases involving domestic violence on Aug. 9.
In both cases, the Prosecutor’s Office found the shootings in Warren, one ending in the death of a 28-year-old man and another, involving a 40-year-old man with nonfatal injuries, to be justified.
The Prosecutor’s Office said both cases “underscore the department’s ongoing concerns regarding domestic violence,” according to a release from the Warren Police Department.
In the first case, officers found the victim, 28, dead of a gunshot wound in the back yard of a home on the 26000 block of Newports Avenue at 2:05 a.m. on Aug. 9. Officers said the victim had assaulted his father, 63, and threatened to kill people on the scene after an argument. The victim’s 25-year-old brother, “discharged his firearm, resulting in fatal injuries.”
Lifesaving measures were attempted at the scene, according to the release.
The county Prosecutor’s Office called the shooting “justified in defense of another” and declined to file charges.
In the second case, on the same day at a home in the 24000 block of Stewart Avenue at about 3:15 a.m., officers found the 40 year old man with a gunshot wound. The victim arrived “uninvited at his ex-girlfriend’s home, assaulted her and aggressively confronted her current boyfriend,” police said.
The current boyfriend, 33, a CPL holder, shot the victim during the confrontation. After a review of the findings, the Prosecutor’s Office declined to issue charges, again citing self-defense.
The Warren Police Department said its Operation Cycle Break, a “proactive domestic violence initiative,” is used to handle domestic disputes before they escalate. Specialized lethality assessments are done and enhanced victim support with community partners like Turning Point Macomb and other intervention methods are offered.
