United Wholesale Mortgage is seeking to dismiss a nearly $100 million lawsuit filed by rival Rocket Mortgage in New York state court, arguing that the three programs at the center of the lawsuit did not violate the agreements at issue, according to court documents.
However, it is not yet clear whether UWM’s motion is before the court. A notice of motion to dismiss submitted by UWM on July 31 was marked “rejected” and “returned for correction” on the court’s online docket. It was not clear Monday why the filing was rejected or whether UWM has submitted a corrected version.
The dispute stems from a lawsuit Rocket Mortgage filed against UWM in May, alleging breach of contract. It’s the latest battle between mortgage industry rivals Rocket Companies, led by Chairman Dan Gilbert, and UWM, led by CEO Mat Ishbia.
Rocket is seeking nearly $100 million in damages from UWM, alleging the company violated agreements involving mortgage servicing rights that UWM had sold to Nationstar Mortgage, which does business as Mr. Cooper and which Rocket acquired in 2025. Rocket alleges UWM violated non-solicitation provisions in the agreements by soliciting borrowers covered by the agreements away from its servicing platform.
At issue in the case are three UWM programs — Refi75, KEEP and Refi Shield 100. UWM argues the programs did not violate the non-solicitation provisions.
UWM officials did not immediately respond Monday to a request for comment on the status of the motion to dismiss.
UWM told the court on July 20 that it planned to file its motion to dismiss on July 31.
“As UWM will show in its motion to dismiss, Rocket’s primary legal theory is irreconcilable with the contract and its other allegations are conclusory, speculative, and utterly refuted by documentary evidence,” the document stated.
Rocket, in a response filed July 21, pushed back against UWM’s arguments.
“Defendant’s attempt to dispute the Complaint’s allegations concerning the nature of UWM’s solicitation programs misses the mark,” Rocket’s July 21 filing stated. “These factual disagreements cannot be resolved at the pleadings stage. While UWM has the right to file a motion to dismiss, there is no question that Mr. Cooper has adequately pleaded a breach of contract claim.”
