Swing and a miss: Appeals court won't reconsider its ruling in Brewers 50/50 raffle spat

The Wisconsin Court of Appeals says it won’t reconsider its ruling barring a Kenosha couple from collecting $13,000 they claim they won three years ago in the Brewers’ popular 50/50 raffle.

Matthew and Annette Flynn filed new documents last week in their ongoing lawsuit against Brewers Community Foundation Inc., a nonprofit fundraising arm of the Major League ballclub.

They argue multimedia video footage proves Annette Flynn made it on time to the designated table at American Family Field to claim her winnings. Those videos weren’t provided to the court before it issued its May 19 decision, but should have been, the couple contends in the new filings.

The court received the couple’s motion for reconsideration on May 28.

On June 1, Appeals Judge Nathan Petrashek wrote in an order that he reviewed the Flynn’s motion and concluded “reconsideration is not warranted.”

Matthew and Annette Flynn have long held in court papers they are entitled to the $13,000 in prize money that was handed out during a raffle held during a July 7, 2023, Brewers home game against the Cincinnati Reds.

Rules of the raffle require the person with the winning ticket to claim their prize at a 50/50 table on the loge level concourse. The winner was given “until the end of the top of the 7th inning (or until the third out is recorded in the top of the inning)” to do so.

The couple claims Annette Flynn arrived at a 50/50 table before the deadline, despite, they say, being misdirected by arena staff.

Another drawing was held and the prize money then went to another winner.

A civil court judge in Milwaukee County found the Flynn’s lost fair and square, and the appeals court upheld that decision.

The couple has said they’ll never attend another Milwaukee Brewers’ home game again. They have hinted they would consider taking the case to the state Supreme Court, if need be.
