Monterey County is cracking down on unpermitted food vendors.
On May 7, health inspectors and investigators from the District Attorney’s Office, in collaboration with the Monterey County Environmental Health Department, conducted enforcement operations north of Salinas and Castroville, according to a media release.
Food vendors operating without the proper permits were shut down, and all food and equipment were seized per the California Health and Safety Code.
District Attorney Jeannine Pacioni warned county residents that unpermitted food vendors selling food from makeshift stands on the side of the road may pose public health risks to consumers.
“Often, these unpermitted vendors do not hold food at safe temperatures, which can lead to food-borne illnesses,” county officials stated the release.
An official with the county’s environmental health department said the vendors were known to neighboring counties and had been spotted in other areas including Pajaro and King City.
Enforcement action came after receiving numerous complaints and informing the vendors on how to operate legally.
Mobile food vendors required to obtain permits
Food vendors must obtain a permit from the Environmental Health Department prior to selling food.
Permits from incorporated cities like Salinas may also be required for vendors operating within city limits.
There are a number of permits available, depending on the type of food-based business.
Operating as a food vendor without a permit is a violation of the law, subject to an administrative citation by the Environmental Health Department.
Additionally, food vendors must comply with rules concerning proper food storage temperatures, cleanliness, and all food must be from an approved source, per the release.
As a result, both the food and equipment used may be subject to impoundment and forfeiture.
Additionally, the Monterey County District Attorney’s Office is authorized to pursue civil and/or criminal penalties and fines for such violations.
